Thanks for all your support guys , just come back from the allotment(i still have keys)
had to meet a photographer from the local paper with my son , the story is getting
printed either saturday or monday ,check it out guys Thisisscunthorpe - news, sport, entertainment, jobs, cars, homes.
For everybodies information the excuse there using is the plot was uncultivated but how come ive just took my gooseberry bush out(it was next to the rear fence ),how come there still is flowers near where my shed was ,how come im finding a few baby carrots ,chopped potatoes . The reporter could not beleive it , i allso now know it happened to somebody else in Scunthorpe but on a different site.
Ive been on the plot for over 1 year , my car was off the road for 5 weeks but i walked there once a week . There is allso worse plots on there then mine alot worse , one of my freinds on there had to divide his plot to give half to somebody (back in april) yet that half has never been attended to ,and no one has seen them.
i am gutted and my dream of my own vegetables for this christmas has gone.I would have achieved this too. Im pleased i took my patty pan home when i did , they are buitifull.Excuse my spelling cant spell for toffee

That is totally incompetent; sounds like shoe-in for the lucky council lady.

I'll be checking that link over the weekend to see the story.

I hope you get some compensation; I'd prepare the minimum you'd be willing to accept in compensation; so the plot back, plus a christmas veg hamper of your choosing and next year's rent free.

At least if they do offer you something you've already got something in mind.

thanks zazen ,i agree somebody thought there luck was in.
Ive invested in that lottie , and i aint leaving it as it is .
I and all of my freinds think its discusting behaivour.
Im certain its now going to press monday well in fact they rang me and told me and asked what produce has gone.
I need some sort of compensation , fruit bushes , seeds , produce , sheds dont come cheap . I had no were to put the shed but i wasnt letting it go either.
The alottment manager has admitted to the press no warnings were given , i think
he now knows the seriousness of the situation.
I have a figure in mind but nothing will replace the hard work , the peace i gain from being there and the relaxation .

well i am dead suspicious that it is a council worker that has been given your plot, although I doubt they know anything is wrong.
conspiracy theory aside, its still typical of local government incompetance at least and they owe you.

                        Hi Tricky

Go to a solicitor and get them to review the allotment contract. Take as many pictures as you can as it may come down to their word against yours.

The contract which is legally binding will state what your requirements are i.e. to keep the plot in cultivation what building structures you can have etc.....

It will also state the council requirements on the alleged breach of contract, the procedure that must be followed in cases of eviction and the number of warning letters that must be issued etc....Councils are not known for their efficiency and will have almost certainly have breached the rules somewhere along the chain.

You have a very strong case to win but most people don't think in legal terms. I didn't either until I met someone a while ago who had several legal successes.

I now too have several successes under my belt including a breach of contract in my old job and a breach of contract with building work that I had done.

You can probably have your old plot back maybe even with compensation if the council were shown to have acted illegally. Remember the contract binds them as well as you. You just need to go about it the right way.

                        Regards

                        Galileo

                        Regards
