      plus you have the housing on your side, they deal with council cockups all the time, they know the council suck at getting things right.
      Don't worry, put pressure on the council to sort it out, you are on incapacity so they cant take what you don't have, if they have overpaid you, then you have to pay it back, but only a certain amount a week, plus if you prove they haven't overpaid you, they have to offset it.
      get down CAB, give them the details, let them do the hard work.
      keep the housing onside by ringing them every week and letting them know you are pushing from your end, an offer to pay, keeps them off the hook from having to take you to court, even if it's a fiver.
      even if they are forced by circumstance to take you to court, the judge is going to say .........no way... and they wont push it, but they will between them push the council to sort their side.
      the trick is to keep in touch with all sides.

        Hope you manage to get it all sorted Lynda - I have no experience of councils/housing/benefits and alike, but reading the advice given above it all looks very sensible to me.

          It's all been said Lynda, but I do understand how you feel (I went through it bigtime after a divorce) Still paying some off now 20 years later!!! but all has been manageable (till I was made redundant on Monday ) The advice you have been given is good advice - CAB, CCCS, moneysavingexpert.com and consumer action group (I used the consumer action group to reclaim £2200 bank charges for my DD's best friends mum) But most of all keep smiling, nothing is as bad as you think, if you keep talking to them they will be less aggressive. ( here have a nice apple ) x

              thanks for all the advice and hugs and support and everything, have exhausted myself now, so i'm gonna go have a nice hot bath with some posh bath thingies OH got me from lush, and have an early night, i'm sure everything will look much better in the morning

                  Dont you dare give up Lynda , ive been there and know how incompetent councils,banks can be.
                  You feel like your banging your head on the wall and nobody is listening.
                  ps me and oh got knocked back 3 times and went through 3 appeals for dla.
                  We finally got it with the help of a support group in Scunthorpe ,im sure you will have one near were you live,you need all the help you can get especially when you tired and cant cope .
                  cab have helped me in the past ,there very good ,hope you get a good nights sleep
                  Take photographs today because tommorow you might not have

                    hi Lynda, have sent you some pms, that hopefully might help. Have had experience of helping people and being helped, in my case it went as far as bankruptcy, and that was a blessing. Ex didn't think so tho' and that was my main reason i didn't really want to go that route, but thankfully i bit the bullet, went bankrupt, faced the legal fight from ex. Within 6mths was discharged. Am now paying bills on time, although it is hard, am a lot happier. Now have an OH that believes if there's money left after bills are paid then can have something if wanted or needed, not like before when it was s*d the bills gotta have xyz NOW.

                    Will be thinking about you Lynda, sending hugssssss.

                      Lynda, your not the first person to get in a muddle and you wont be the last, there is help out there, don't be afraid to ask.
                      The first step is the hardest, once that is over you'll be on your way to getting this sorted.

                        Is this country going down the pan quick or what, i am really really sorry to hear about your troubles,! Done give up you are a fighter and i tomorrow is another day and you will be stronger!

                        At the mo, i think the doldrums of life have caught up with just about everyone!! Merry Bloody Christmas everyone NOT!!!!

                        The best pressie for all of us is to see sodding Gordon Brown strung up by his balls on this biggest christmas tree this year and with no chance of him ever getting down!

                          (((((((x)))))))),nothing more I can add hun,other than..they can't take what you haven't got!!I'm sure the housing association won't kick you out...they'd then have to find somewhere else to house you.As others have said get down to CAB 1st chance,the council & debtors will listen to them a lot more than they will you.
                          We were in a similar position around this time last year,(Our landlord decided to sell up,so we were in a mad paanic finding somewhere else to live,desperate not to move DD from her school & friends.Although I could have done without the stress at the time,we're in a much better house now(even if it is nearly £200 more a month!).

                            ok today is another day ....... fell flat on my face getting out the bath,and twisted my back, so that sleep thing evaded me most of the night, but the bath smellies were lovely (should be at that bloody price) ........ and as much as i'd like to i'm not sure i can blame gordon for this ...... ok maybe i can can i paint em purple and cover them with glittery superglue?? .... we could start hassling the scunthorpe council bloke too

                            had a good chat with rob last night, and if the worst comes to it, he's gonna move back home ....... and much as that would make me happier, it's definitely a last resort, so he's gonna bring me some choccy home after work bless him

                            i've just had a big chunk of hot just cooked bread and butter covered with strawberry jam, and i've nearly completed command and conquer again

                            anyway, they can't evict me i've just got 12 new raspberry plants courtesy of mr mail ...... and 10 strawberries ....... would be crap having to push them round in my bag lady trolley ....... all the soil would fall out

                              I just had a thought ... is your house now "under occupied" if Rob has moved out?

                              This happened to me when I got cancer. My housemate moved out, so I had a 2 bed house all to myself, and the council refused to pay the rent.
                              I had to move house while having chemo. It sucked big time.

                                nope too much choccie got out, couldn't feel my left leg and it decided it wasn't playing

                                don't think they do the under occupied thing, anyway, although rob doesn't live here, he's only classed as temporarily away from home ....... even though it's for 5 years it's still classed as home during the holidays..... anyway, they don't have any spare one bedroom houses ....... and i have 4 'children' still living at home

                                can't believe they did that when you were sick ..... ba***rds
