    I would back up the other Grapes and report your BIL. The Child Benefit etc is not for him but for your niece. I will not comment on your BIL. Just try and keep strong.

      Been to cab they suggested a solicitor been to them the next thing as he isnt in agreement will be a letter from them landing on his mat. We tried the nice way. Battle commences, though we dont want to fall out with him over it, but I think we will. I will not stand by and let him ruin my nieces life. He knows how much she meant to my sister and the last thing she said was that she wanted them to live in peace and harmoney, she knew what would happen.
      Please if you find yourself in a situation that one parent or both may not survive to see the children reach 16yrs or whatever make sure you have proper plans in place as to what will happen to your children should something happen. Its not always as cut and dry as you think.

          Thanks pootle. good job I am made of strong stuff and come from a strong loving family lol. My dad died when I was six so I know a bit about how my niece feels, mum died aged 92 yrs and 3yrs before my sister. We have always been there for each other but dont live in each others pocket. I think my other sister being the eldest takes the brunt of everything and organises us all lol, we call her bossy in a loving way lol

              It is in the hands of solicitors now so we wait.
              I knew I would get the support of you lot I talk to my sister but dont always say what I really feel and I can do that here. I dont want to add to her worries.

                I'd agree with this. Also, I don't see how your sister and good BIL can possibly suffer for not declaring the money. After all it's not something they have earned, the money is that which the government has decided every child needs and therefore will assume that all of it was spent on your niece. I think they should declare it and its non-payment though.
                Into each life some rain must fall........but this is getting ridiculous.
