    Oh my Goodness!

    How awful for you both. Try not to think of what might have been, I know it's hard not to. Rebuilding your daughter's confidence will be very important so that she becomes a confident driver once again.

    DD & I were once going into town on a bus driven by a foreign driver. He went around three roundabouts the wrong way. First was a mini roundabout so not much of a worry, next was one where everyone could see us coming across the grass in the middle, but the third was covered in big tall trees and other drivers couldn't see us at all. When we complained to the bus company, the people in the office thought it was funny

      Thank God! This will be a warning and a lesson for the lorry driver. He will be more careful in future.

        I have spent two hours on the phone this afternnoon to the insurers who now tell me that as she has only 3rd party fire and theft and the lorry drivers insurance is in Romania, they will not be pursuing the claim. The only way we could try and claim is by contacting the foreign insurers ourselves! I do not drive and understand very little about car insurance but surely this cannot be right? Cannot anyone help/advise us?

          I'm sure there's a fund or something that you can claim from when you're in an accident with an uninsured driver... This certainly doesn't sound right to me, that you're supposed to pursue the claim yourself?! If you think the insurance company are ducking out of their resposibilities you can complain to the Financial Ombudsman Financial Ombudsman Service
          Hope somebody else can help more...

              Try CAB.They're bound to be able to point you in the right direction.I may be wrong,but I'd be a little wary of the "no win no fee"peeps...do some research before you commit to anyone!

                If she was injured...didn't the police attend...I would be very surprised if the police were not there at a motorway incident. They will have given the driver a producer. I would give the police a call.

                No Win - No Fee........will not be interested, who are they going to sue?

                  With 3rd party you are only insured to pay for the damage to HIS car. There is no Cover for yours. So why would they want to know.

                  That is why you have comprehensive insurance.

                  The uninsured Drivers Fund Uninsured drivers agreement

                      Hi NOG, yes the police did attend. Luckily, no, she was not injured apart from the emotional trauma and some bruises. I just thought maybe we could claim off his insurance for uninsured losses. From what I gather, he admitted fault. We have very little money because of hubbie having PD so I am the only earner and I thought if we could at least get a little back for her to put towards another car it would help.

                      Yesterday she was not good. She would be fine for a short while and then burst into tears and re-live the whole thing. She says when she closes her eyes all she can see is the front of this juggernaut and yes it is Sam from the vine.

                        Thanks for this NOG, I understand now. Unfortunately we could not afford fully comp for her at the time and the car is old, so it didn't seem worth it. The damage to the car exceeds its value so that seems to be the end of that.

                          BIG BIG {{{{{{{{{{{{hugs}}}}}}}}}}}} to SAM,we have had chats on the old ctam thread,know what it's like being hit by another car,1 front wrote the land rover off,1 back shunt,both whipe lashes,and the first 1 bruid up face and 2 black eyes,and a near miss,the bloke stoped and said sorry,but he still had all the barrels i could muster,she will re-live it time and again,talking about it helps a bit,it does fade into the back ground with time,but will still have flash backs in certain situations,even seeing another accident,best wishes to her

                            Surely the lorry was owned (or at least being used) by some commercial business in the UK? THAT is who I would be trying to tackle for compensation (first off, the cost of car repairs).
                            Flowers come in too many colours to see the world in black-and-white.
