HELP! UPS demanding money!

Long story but here goes; my OH sold an item on Ebay which was 'collection only'. It sold to somone in Poland. My OH contacted them to remind them the item is 'collection only', no probs was reply, I have a UPS account and will arrange collection. Item was left at our gate & UPS collected. All was well until last week when my OH received a demand for over £300 as the bloke in Poland has refused to pay his bill with UPS. UPS' argument is that 'the sender is responsible for the item and it is in the t's & c's. 1- there was no 'sender' as collection was arranged by the chap in Polanad. 2- As OH does not have a UPS account & was not around when item was collected [UPS chap filled in the paperwork upon collection] he has never had or seen t's & c's.

Does anyone know what we do or where we stand.Ii want to go to CAB but an appointment is weeks away...................help!

No........that implies that you think that you might have a contract - even unwritten.

By all means check on line but don't ask for them.....

Understand what you're saying but if you are being asked for money and I presume that it's been asked for not over the phone but in writing which is why it's been posted on here then I would ask for the T&Cs, they were the ones who quoted it. You are merely asking them to confirm their claim and prove it. Minskey has already spoke to UPS by the sounds of the 1st post on here anyway and that's why UPS has quoted T&C's.

They are nothing to do with Minskey!

It's like when you get a parking ticket from a non-police or council agency - if you call up and say you aren't paying it, you are confirming that you recognise their right to bill you. So, you ignore ignore ignore - otherwise you are getting into the argument in the first place.

under support you can download the terms and conditions. They don't actually define the term sender (unless I am being blind).

You have not entered into a contract with UPS, you've not instructed them to either collect or deliver the item and, therefore, no contract exists between the two of you. Tell them to sod off and chase the guy in Poland for the money! If I can help pm me

He would have had to have instructed them, and had an account - so it's him they need to chase.

If anything - the only response should be 'it's not up to me to make sure your procedures are not up to scratch, is it?'

For what it's worth I agree with the others guys. Ignore what ever they send and IF they start getting nasty, tell them you'll contact the Consumers Group (Brilliant bunch of peeps who knows what what and will fight your case) and see them in court. They'll soon back down.

My OH (who tends to know about such things) says that if anyone in your household signed anything, there MIGHT be liability to pay (depending what was signed, and whether any opportunity was given to see what was being signed), but otherwise, just keep saying "nowt to do with us" (if you say anything at all). If they actually claim that there is some kind of contract, demand to see evidence that this exists. If the UPS delivery person filled in the form and no-one signed it, they may even have put themselves in a bad position, it might count as forgery!
