      I think Zaz has given good advice to you here Mrs D. I've to conduct a Disciplinary Procedure for Senior Management and HR against a member of staff next month. I hate the bladdy things, but it seems I'm chosen because I'm impartial and fair. The result of the last two that I have been involved with is that both members of staff resigned before they were sacked, but after negotiation. Whatever you decide to do, good luck.

        I have been through a similar situation very recently myself. I made the fortunate decision to join the union within a few weeks of getting to know the management team where I work. If they had decided to sack me (not the team I work with but those in higher authority) for what turned out to be breaches of the trading standards act they would have had to sack the rest of the staff because we were all trained to do the same thing. I have still not found out who was responsible for setting up procedures that were in breach of trading standards law. But I will. And they will answer for it. See....even though I have had a letter saying no further action is to be taken, there has been no apology or two way discussion. You can probably tell how angry I still am. You must feel the same and it is still raw.

        You have rights and you must uphold them despite what others are trying to do to you. Stay until you are sacked and go for unfair dismissal. Have you tried Citizens advice if you have no union? To thine own self be true. X

          Bet that's a load off your mind Suzanne. Whatever happens now is in the lap of the gods, that's got to be better than it being in the hands of your bosses

            Yup - it's the private property/company property thing that does it for employers.... you can even have charges of industrial espionage levelled against you, depending on what you record. It doesn't matter whether it's for your own 'protection' either....

              Spoke to my boss this morning, offered to work my notice if they stop the disciplinary, he said fine, but had to check with personnel, got back to me 7 hrs later, with a no, if I work notice they will do disciplinary, so I offered my immediate resignation, effective that moment, signed back my keys and walked out. Shame really, but Id rather keep my record clear of dismissal. Ah well, we'll see what happens with the 50 applications Ive put in, only had 3 immediate email knock backs, so here's hoping something better, working for a company that values its staff comes along soon!

              So, anyone know how I go n sign on?

              Feeling much better about life now, thanks for bearing with me and offerring advice and encouragement!

              Oh and if anyone wants a hard working store manager in the north west of england........

                    Apply for Jobseeker's Allowance online : Directgov - Do it online

                    Sorry about your job hope things work out for you soon.

                    There are also phone numbers when you start application if you need further help.

                      Whatever you do, get yourself along to the CAB. Even although you have resigned, that can still be treated as constructive unfair dismissal. Protect yourself at all costs. Personally, I think you did really brilliantly sticking it out as long as you did.

                          I think AP's advice is spot on. Make an appointment to see a CAB advisor at your earliest chance.

                          I wouldn't trust these buggers as far as I could throw them.

                          Just a thought to put in your mind, I don't know who you used to work for but if they a big/national company the one thing they fear more than anything is bad local publicity.
                          I won't go into detail but I was a contracts manager for a national company and had cause to get rid of two sub-contractors. On the day of the court case which we would have won the national manager turned up with the company cheque book and payed double what they were asking plus expences, just so that the case would not be reported in the local rag.

                            Well, I for one am happy to boycott Halfrauds - I prefer our local motor shop anyway. My dad's been going there for the last 30 odd years anyways.

                            Thankfully there are companies out there Suzanne that value staff and care about how they treat them. You'll find one, of that I'm sure.

                              I offered a compromise with my boss, if they accepted my resignation and stopped the disciplinary I would work my notice, he was fine with this, but after checking with personnel he came back and said if I was to work my notice, then the disciplinary would have to go ahead, so I walked on the spot, signed back keys and made my resignation effective immediate, which means they wont proceed with the disciplinary.

                              Ah well, tis over now
