Selling Heritage varieties

Is it illiegal to sell self saved heritage seeds or sell heritage home grown toms? we were discussing what to sell at our school fair for garden group and someone thought it was.

I know that school fetes can have a more lenient approach to selling in general but was wondering in general what the "law" was in general to selling heritage varieties?

If you have this years Heritage Seed Library Catalogue there are some Terms and conditions on the back of the order form. It defines the difference between commercial and non - commercial use. If it's for charitable or fund - raising events then that's ok.

Ahaa.... so its ok to have at school days and have on stall with a suggested donation to garden club! But wouldnt be ok for me to take to market and sell direct, or even offer with a suggested donation to me (or vendor) as this would not be charitable but purely profit based. Tha right?
Cool, school group can be reassured we are not breaking the law them, I will prepare a carefully worded sign!

Pretty much; what I do with seed swaps [which often include self saved seeds] is to offer the swap or a suggested donation of 50p/£1 per bag. With plants, it would be ok to sell I should imagine as the price also includes the pot, compost etc so as long as you aren't taking the preverbial...you get the gist.

What the gvt don't want is commercial peeps making a bomb out of unregistered seeds, and what the seed savers [who originally may have saved seeds you went on to save] is you making a bomb out of their hard work - I'm sure nobody is going to take umbridge at a school seed or plant sale as the money would go straight to garden club [so it's a donation to the club of a suggested amount that reflects the item].

So am I right in thinking then that if you are trying to encourage peeps to grow stuff then it's ok to spread the word (seed) as long as there is no monetary exchange.

Absolutely. As long as you don't start a business up making huge profits from unregistered seed....you should be fine.
