  • Buyer's protection my backside

Bought a lawnmower on ebay that was seriously damaged on arrival. Opened a dispute. Seller agreed to full refund inc delivery. This all took some time during which Ebay phoned and explained

    a) That I was not entitled to refund of postage

    b) That I had to return machine at my cost otherwise I wouldn't be entitled to any refund

machine only cost £30 with carriage of £20.

In the meantime, seller still agreed to full refund but balked at charge to paypal which I said I would be happy for him to deduct.

Seller then asked me to settle dispute and he would then pay. Well, I'm only getting a tenner back if I have to pay carriage back to him if Ebay determine dispute so "in good faith" I mark dispute as settled. Not surprised that refund still not made.

Am I allowed to say "bl@@dy thief" in feedback? I'll soon find out.

Have you put this on the community boards on eBay, AP? I find them very helpful. And are you sure it was ebay who phoned you, not the seller posing as ebay? It has been known to happen. Can you phone ebay to check?

I was sure that you were entitled to a full refund if the goods were damaged, including postage. And as for "Seller then asked me to settle dispute and he would then pay" .....lesson learned.....

Now having had this happen to me from the other side, we have always refunded in full including postage. When you are taking out carriage you get insurance which allows you to reclaim costs in the event of damage during transit. £20 seems a lot of carriage, we use an online courier which would have sent something of that weight and size for about £7, excluding packaging.

I hope you get it sorted AP.
I'm only here cos I got on the wrong bus.

Seller would not have had my phone number Jules and I'm ex dir.

It's not a hooge amount of money and sometimes you have to take people at their word. I can put a second hand engine on at a fraction of the price to buy replacement parts.

i did that once and if the person recieving the feedback puts a complaint in ebay simply remove the feedback and give you a finger wagging, dont jump to leave feedback take your time for a few days and think out your wording

I may be wrong AP but doesn't Paypal have a dispute policy.

I think to ease your own frustrations AP, you may have to weigh up if the lawnmower is good value @ £70 if you have spend a further £20 on it.

I would escalate through Paypal . Goods not as described.. If vendor wants them back he pays postage.

That's what I did when I had the same problem. Sorted. vendor gave full refund plus 100% of return postage...

I thought I had put a dispute through Paypal & was successful but was thrown out when AP mentioned an ebay dispute.

indeed matey. It's just so annoying being suckered.

Paypal and Ebay disputes run hand in hand. If you raise a dispute in Ebay, you can't also do so in Paypal. Ebay own Paypal

You;re not entitled to a refund on postage, but any good seller would do so.
Ebay really not the plave to be buying large objects unfortunately, unless collecting
As others have said, any non factual feedback will just be removed.
Tbh, it sounds like you won't get much more than, "goods damaged in transit, seller offered refund but not for the expensive postage"

I don't agree Kiz. I've bought similar items previously without any problems. Feedback will be factual.

Whatever the outcome AP, I hope you end up with a lawnmower that in the end was value for money.

That's a shame AP. I bought a mower last year as new and once I got it open it was covered in old grass!
I emailed seller who immediately refunded me more than half the cost (bargain!).

I think if you'd just escalated to a dispute without making that deal, it would've gone in your favour. If you were feeling malicious and vindictive I guess you could monitor that seller's future listings and contact all their bidders to warn them.

I'm more annoyed at myself than the seller so I won't be being vindictive. Getting it off my chest has settled me down again. Should maybe just have stuck it in the rant page.

Well done on your bargain TS
