Planning Permission Help

Have logged a formal complaint with the council today. These kind of complaints are anonymous, which is good.

What annoys us the most is that they are bang out of order for just starting to do the work.....unfortunately with the gravel being dropped today, its going to be there and practically finished by the time we get home anyway. We did wonder if it was worth ringing, but we have rights and there is a proper process that needs to be followed and he is ignorant enough just to go ahead without following it.

So.. they own the field at the bottom of your garden?.... I thought you had that and were putting your veg garden there?

Sorry.... let me explain

Our field/bottom half of the garden is our veg patch, chicken run (from the back of our house to furthest end of the field/garden its about 400ft I think) and second lawn area.

Our neighbours land is shaped like a T, with their house being at the bottom of the vertical, and our garden ending under the left hand horizontal line.

The sand paddock area will sit on the left hand side of the horizontal, therefore sitting directly behind our house and field/garden, whilst still being on their land.

There, is that confusing enough?

Thanks OWG, very clear description. As to what you can do about it.... Block their driveway and stop the lorries? A bit agressive but once it is built it will take a court order and baillifs to get it taken out!

Try and speak to the other neighbours and get a petition, involve your MP on damage to the area, or beauty point or site of natural interest or some such.

Be B***y rude to the new lot and inform them they have to stop or you will seek a court injunction. Get a court injunction!

We can't stop the lorries as they'll have done all the work in 2 days when we're away from the house.

I'm fairly sure the neighbours on our other side will complain, but I doubt anyone else will, as the plans won't encroach onto their view/privacy etc.

I'm going to wait and see what the Planning Office do next week, and take it from there.

At the very least the new neighbours could buy and plant us some hedges!!!

P.S. Did to try to post a plan, but my .pdf was too big and I'm not technical enough to resize it!

It may be that he is not ignorant OWG! If the work is done then he can be made to apply in retrospect but even if the planners refuse it can be years before they fully enforce the order and he can appeal making it seem that he has got away with it. The only problem with contravening the planning authority for him would be when he came to sell the property.

I rang the planning office on Friday and they said that they would investigate on Monday and let me know the outcome. Since I was at work yesterday, I don't know whether they visited our neighbours or not. I'm hoping for a phone call today.

This is the view from our bedroom window. The allotment is to the left and the large patch of dirt at the back of the picture is the sand paddock (as yet unfinished)


This is the view from our orchard (allotment to the left). As you can see, it's very close to our boundary. Don't think we'll be sitting in the orchard during the summer again!

This is the boundary that they plan to build the garage and stables along. The horse box is on their side of the fence. The plan is to take up the whole of the boundary you can see (to the corner of our garden) with buildings. So instead of an open boundary, we'd have the back of the stables and garage (which incidentally are going to be brick with white render to match the house)

Unfortunately for you but not for them the whole planning permission system is changing to make it easier to build and very much more difficult to prevent.

As the buildings are going to be away from the public highway and their house it appears that they will be able to build merrily away.

At least you have a huge distance to their proposed build, most of us have to grin and bear any building work appearing about a metre from the kitchen window.

Why exactly are you objecting to it, just the loss of view?

Look on the bright side - if you can't stop them - and it doesn't look like you can - you will have long wall to plant against. It might be quite a warm wall too, from the photo - west facing? You could grow cherries, nectarines and figs! Expand the orchard along the back fence with some pears, plums and apples - you get more, and a wider variety of, fruit and you block the view of the wall and sand paddock and the extra trees will absorb some of the sound and give you privacy without significantly reducing the light levels in your garden.

Not a perfect answer I agree, but it might minimise the impact to you?
