Fit For Purpose?

Hiya, just want to pick ya brains............
I ordered 2 pairs of winter boots advertised as size UK12. They arrived really prompt but are a EU46 which to my calculations is UK11 plus 3 of the 4 boots have damaged linings (Holes in the heels). They cripple me but the returns policy states I have to pay P&P to return them. I have emailed the seller as I don't see why I should have to pay return postage on something not fit for purpose...........If I don't get any joy then I will open a dispute through Paypal.
What do you think?

What should I do if I’ve received something that doesn’t match the item listing?

What determines if an item is ‘not as described’?
A ‘not as described’ item should be materially different from what the seller described in the item listing. This includes:

• Different item or version
• Wrong condition e.g. the listing stated the item was ‘new’ when it’s clearly been used
• Missing parts or components (e.g. a listing for a camera kit stated it would include a tripod, but it’s missing)
• Defective during first use (e.g. TV didn’t turn on)
• Counterfeit item
• Missing major parts or features, and this wasn’t mentioned in the listing
• Damaged during postage
• Items that arrive much later than promised and can’t be used (e.g. concert tickets)

Paypal will refund you whether the item is returned or not. Paypal is biased towards the customer not the seller. If you pay the return it is based on the seller refunding addition cost and not likely to happen(IMO). So yes open up a case and if the seller has any sense he will arrange them to be collected and send out the right ones. If I remember rightly it all needs to be sorted within 28days but could be wrong.

I bought a cake display item through PAypal and it didn't arrive, the seller wouldn't return emails, answer telephone etc. I raised it with Paypal and my money was refunded the same day by the seller.
If they sent you the wrong size, you should be entitled to full refund - no postage costs

Paypal refund and the seller has no control of it (as paypal have the sellers bank details). It is why on larger items such as cars it is cash only. As people were (and possibly still do) pay by paypal then collect cars then get the refund, It is dreadful really but it happens

I have 45 days to raise a dispute so will give the seller the benefit of the doubt first & will use Paypal as a last resort. I opened a dispute through Paypal years ago & they were very good but want to give the seller a chance first.

BM, I would open the dispute to protect your position. You can easily close it if the seller puts things right.

I've logged it through ebay AP. If I have not heard anything by 23rd then they will take up the case.

I think:

• that is for the situation where you receive the goods and then decide you don't like the colour and want to return them.
• that "Not of merchantable quality" falls under the trades description act and as such is the sellers problem.

If you paid by credit card (and I expect paypal is the same, i.e. you were using Paypal funds, rather than credit-card-via-paypal) then the credit card company can make a Charge Back on the supplier - this is a penalty charge, over and above the amount of the transaction, so it winds up costing the supplier money. Thus, usually, suppliers will Refund before the Customer complains to credit card company and thus triggers a charge-back.

Most times I have found that the supplier has refunded me the purchase and said "keep the goods" as it was presumably not cost effective for them to get them back (e.g. the goods were fine, but just not what I ordered).

Yes, I would try the polite way first. However, I have had disputes opened against me after three days of no contact. Everyone is different! (It was exceptional circumstances - no internet, and the seller had been messed about by buyers in the past, so I couldn't blame her.)

If you have to resort to hard tactics, you will almost certainly be successful with PayPal.

You'll get a full refund if it was done with Paypal.

Sympathy with the seller. Not their fault and they'll make a loss on the deal, but an occupational hazard of selling footwear on the Internet.

Most footwear is made in the Far East nowadays and personally I've found the sizing to be a rough guide, rather than an exacting standard! ...

I have trouble with footwear, because I don't wear leather. I get mine from ebay now also.
The most prudent thing is to get one pair and see that they're comfortable and fit, and if they do, go back for another pair or two.
