Garden sheds....

Are there any rules about how tall a garden shed is allowed to be? My next door neighbour has started to build his own, it stretches almost the length of our short back garden fences, (about 10 feet long I would say), it's right up against the fence between our gardens, and already 18" to 2' above the top of the fence, and that's to the eaves. He's not put any rafters or roof on yet.

Having a north facing garden, the only sunshine I get is late afternoon from May to October. This shed is going to cut out a lot of direct sunshine during those months.

These are not nice neighbours and we don't speak. Do I have any legal rights do you think?

So I need to see if it will be flat or pitch roofed. To be honest, if he puts a flat roof on, it wouldn't bother me too much, even though it is only about a foot from the boundary fence, not the required one metre, 'cos it wouldn't block too much sun, and in the interests of peaceful relations I wouldn't complain. But if he decides a huge pitch roof is needed, I may have to take steps.

My neighbours sheds right up against my fence & the pitch roof overhangs my garden about 10cm,I could saw off what's on my side

Gosh, that's a bit of an imposition, JJ. I've looked up the government planning regulations. You'd be within your rights to ask your neighbours to shift their shed at least a metre away from the property boundary (and that's two metres if the structure is over 2.5m tall)

The people at the back of us built a brick built shed up against our fence, I mean right next to. I really don't need a back fence. It was also about 2ft above the fence.
Took them through planning and they lowered it to an acceptable level. I could have made them move it backwards as well

Anything that imposes on your side of the fence (including trees, shrubs etc) you have a legal right to remove but you have to give them back to your neighbour. If you have had any windows on that side for more than 20 years and the shed interferes with any light that normally comes through them, that's breaking the Right to Light law unless you give them permission to do so. As well as looking at the links posted on here, I'd go to Citizens' Advice to get the full info and the necessary steps to take if it looks like becoming a problem.

I'd go to your local planning people to see if they have planning permission (doesnt sound like it!)

Although the regulations can be arguably OTT sometimes, they are there for reasons exactly like this. Don't compromise just to keep relations

Thank you for the compliments, Sparrow and Scarlet The veg are on the right where there's a modicum more sun, and the flowers have to make do and all squash together on the left where it's shadier.

No more progress on the shed as yet, I guess it's a weekend project
