    I think that the OP was asking 'can I sell...?', rather than 'should I be able to sell....?'

    The opinions given try to address the former question, I think, although the latter would be an interesting topic for discussion, as Paullottie says - perhaps under a different thread

      Don't some councils allotments have their own shops? Or is it just private ones?

        No, it is common on council sites to have a 'shop'

        There is no distinction made in any Act between private profiteering on site or associations running a shop. Strictly both are a 'business.' However in practice shops selling gardening sundries merely benefiting the association are tolerated and not regarded as a business. Afterall it means the sites are more self funded reducing any council input.

          We have a shop but the only produce we sell is Honey... which is not covered by the act.

          As we have a Show Hall we collect all the surplus produce and run OAP dinners.

              Tax man

              The secretary of my site has adverts on the main road and sells loads of produce. I've often thought what the Tax men would think about someone selling produce for profit?

                I am sure the taxman has bigger fish to fry. You'd have to go some to reach the tax threshold from one plot....Still sounds like he's flying a bit close to the sun though as it doesn't sound much like an honesty box with a few excesses...Are people coming onto the site to buy? ....ADVERTISING!!!...Not very subtle, a bit rich and an abuse of his position too.

                    He sells everything that comes into season from his two large plots, onions and shallots at the moment, runner beans and garlic next and yes there is a steady flow of custoners, however he is a good secretary and his coffee and tea is prices are very reasonable
