  • Legal advice being sought after being told to leave my plot by April 2010

    I took over my plot on the 5th Nov 2007 in a derelick state since then I have worked hard to improve soil condition, bought a new shed and greenhouse. Things looked rosey I enjoy my allotment tremendously.
    The Chairman of the site resigned at short notice about Dec 2008 leaving a void at the next meeting plot holders voted me on as Chairman (I regret my decision to accept so much) Being employed management I attempted to bring the site into the 21st century - it was only half occupied and was in a poor state of repair - perimeter fencing, roadways etc.. The land is owned by a private organisation and there was no constituion nor tenancy agreements.
    I atempted to bring the constituion, tenancy agreement and increase the rent from £3 a year to £10 to cover the cost of improvements. All "hell let loose" and I was voted off at the next meeting but there was so much anger from a small number of plot holders who no longer speak to me (this I can live with). But they have influenced the new Chairman to inform me that I am to leave the site by April 2010. Where can I go for assistance to avoid this action.

    How about the owner's of the site? What are the 'grounds' for your eviction?

      The conversation that place today with the Chairman was that during the time I was Chairman a lot of bad feeling was brewing up but instead of speaking out at the meetings small numbers of plot holders were banding together mainly the elderly ones who more or less run the site and I have been told have "run off" numerous plot holders in the past. I am looking for a new site but there too long a waiting list on most

        By the way I am no spring chicken at the age of 56 but there are about 6-9 over the age 60 and I hope no offence is taken any member older than by my post I have not got an issue with the age of plot holders some who are older than do speak to me

            He hasn't given me any I enjoyed being a plot holder and have one of the tidiest plots on the site and I have not argued with plot holders because they don't speak to me

                He informed me that there have been members who dislike the bad atmosphere when I come onto the site and that some have seen my car in the car park and gone back home

                  Are they complaining about the fact that you want to put the rents up. Our rent is £23 per year for a 10rod(16th acre) plot classed as a half plot so I think money wise they should have nothing to whinge about. Surely the people who voted you on should have a say after all it sounds like you'yr working to improve the site.

                    Just say it will blow over; they will get over it. And start being really friendly to everyone; well, say good morning nicely!

                    If he gives you notice in writing; then get the legal NSALG side onto them. I'd join them now if I were you.

                      That I was binley100 but I am no longer the Chairman and the new Chairman in my eyes is being used as a puppet for the people who want me off the site. They have been there for years and will not accept any changes. My wife, 16 yr old daughter and myself hacked our way through brambles and nettles to show that if we all pulled together the cost of improving and attracting new plot holders would be minimal. And a full size plot for £3 pounds is still cheap. But they would not accept it so voted me off and sent me to coventry so to speak -- so from June until now I have worked my plot and it is a tidy plot without speaking to hardly anyone and they not speaking to me which does not bother me but this is now the last straw

                        Thanks zazen999 I shall give them a call on Monday but legally I know they have no grounds to evict me it is down to a small minority who still harbour grudges

                          I think it's time you wrote to or rang the owners of the site, and explained to them what is going on, and why the site isn't fully tenanted. They really ought to be charging more rent and using the money to sort the site out themselves.

                            Seconded I think they've got it too easy especially on the money side.

                              I even contacted the young offenders and had a team every Sunday down on the site helping me to get it in some sort of order the problem is they and I did such a good job that the site is now nearly full what a fool I feel like !!!!!!
