  • Administration boring but necesary

    Help needed. We are a new Association and have two sites. One with 25 plots the other with 8. We need proper rules, membership forms and tenancy agreements but no-one wants to sit down and draft them out...........to be honest we probably don't fully understand what we, as a Committee need to cover. Been on the net but everything we pull down seems full of legal jargonese.

    Anyone got something simple(s) we could crib from? OR ideas we could use. We have some Committee members who want to tie everything in so many knots that it would be doubtfull if any plotholder had the right to be on the site in the first place!

    The only positive thing I've done so far is get everyone Public Liability Insurance and membership of NALSG and I did contact them but they weren't much help on the rules and regs side.

    Go back to NSALG - if you are a member it is one of their 'services'

      We used these NsALG, and just modified acouple of bits to suit our site. I should have a copy which I will pm m you tomorrow if you would like.
      I could not live without a garden, it is my place to unwind and recover, to marvel at the power of all growing things, even weeds!

          Draft your own legal agreements at your own risk!

          It's a solicitors job . Full stop.

          Every clause in a lease is open to interpretation. Most have been the subject of interpretation by the highest courts in the land.....every single clause.

          Draft them improperly and you will end up in hot water and the lease you enter into might not be worth the paper it's written on.

          Please take heed!

              Really your committee needs to sit down and agree on a set of rules, then you have an AGM with all plot holders invited and discuss and vote on said rules . Basically your tenants (plot holders ) have to agree to abide by the rules of the association . We have just agreed and voted on a constitution ....no solicitors involved . Anyway the NSALG has solicitors and that is why you pay your fees to them .........

                  Please don't scaremonger Newton. The whole point of using the NSALG draft lease agreement is that they have set it up in the right legal framework so that you don't have to. Our committee built our rules, and our lease agreement from the NSALG one. It's common practice. That's why you pay them money...
