Should I argue my right for a plot?

I have just read in an allotment book that the council are required by law to provide land for allotments if more than 6 people on the waiting list are on the electoral roll. Has anyone ever used this knowledge to get an allotment? I don't want to fight for one (when I know there are empty plots on my local allotments) if they are likely to ignore me

A quick goggle search reveals that Hull,Yorkshire has got waiting lists for all their plots - so they suggest joining Landshare or one of their 'community allotments'

I am 26 on the waiting list there are 4 empty and quite a few neglected (it states in the tenancy if your plot is neglected you will get evicted) this is why I'm thinking I should argue it?

I think the others have put it quite well. Your Council is providing allotments. Maybe ask how long you are likely to have to wait. It's not unreasonable to manage allotments including having a waiting list. It does rather keep folks on their toes viz a viz keeping their plots tidy if there is a threat of being evicted

They are required to provide more though. I have already asked and the wait is at least two years

Do you know when rents are due? Ours run with the financial year, so there tends to be the biggest turn over around then. If yours are a similar timing some of those empty/ abandoned plots might get shifted and you move up.

Have you asked about the empty plots though? Do they know they're empty? If so, why are they empty? Pester a little about these and you might find yourself jumping the queue as it's possible others on the list ahead of you have since lost interest. I think the law only requires them to provide land, it doesn't say how long they can take to find you the land...

Get yourself down to your nearest site Mumbles, and speak to the plotholders, and also the site rep if you can find him/her.

Push, Push, Push.

If the council is doing it's job there should be no empty or neglected allotments. If you don't push them they won't do their job.

If it gets to April and there are still allotments abandoned. or just covered in plastic or carpet, or used for non growing purposes eg: playground threaten to go to the local press.

There is no excuse for the council to let allotments stay in a "no grow" status while there are waiting lists.
